JSimpleList Terms of Use
These Terms of Use apply to your use of JSimpleList, including the Android app, browser app, optional online accounts, online list synchronisation, private list sharing and related services.
By creating an online account or using JSimpleList, you agree to these Terms of Use.
1. About JSimpleList
JSimpleList is simple list-keeping software that supports local-only lists and optional online lists for multi-device access and private sharing.
JSimpleList is produced by JobSheet. JobSheet is a registered business name of 21 TWELVE CONSULTING PTY LTD ABN 31 692 386 771.
2. Local and online lists
You may use JSimpleList without an online account. Lists that remain local are stored on your device and are not uploaded to the JSimpleList online service.
If you choose to make a list available online, the list and its contents are stored and processed through the JSimpleList online service so they can be synchronised between supported devices and browsers and, where you choose, shared with other users.
You are responsible for deciding whether information is suitable to place in an online or shared list.
3. Your online account
You are responsible for:
- providing accurate account information
- keeping access to your email account and JSimpleList account secure
- telling us promptly if you believe your account has been accessed without authority
- making sure your use of JSimpleList complies with applicable law
You must not use another person's account without authority.
4. Shared lists and invitations
The owner of an online list controls whether that list is shared and who is invited or remains a member.
A list owner may remove members from a shared list. A member may leave a shared list.
Users with access to a shared list can view and may be able to change its shared content. You should share a list only with people you intend to give that access to.
You must not use invitations or shared lists to harass, deceive, spam or unlawfully contact another person.
5. Your content
You retain ownership of the list names, list items and other content you enter into JSimpleList.
You give us permission to store, process, display, synchronise, back up and transmit online content as reasonably needed to provide JSimpleList and its sharing, security and support functions.
You are responsible for the content you enter and for ensuring you have the right to share that content with other members of a shared list.
6. Acceptable use
You must not use JSimpleList to:
- break the law
- send or store fraudulent, abusive, threatening or unlawful material
- access or attempt to access another user's account or data without authority
- interfere with the security, availability or operation of JSimpleList
- upload malicious code or attempt to damage JSimpleList systems
- misuse invitations, sharing or other service features
- use JSimpleList in a way that creates an unreasonable security, legal or operational risk
7. Availability and changes
We aim to provide a reliable service, but we do not guarantee that JSimpleList will always be available, uninterrupted, error-free or compatible with every device, browser or network.
We may update, maintain, add, remove, suspend or change features as JSimpleList develops. Where practical, we will try to minimise disruption and provide reasonable notice of material changes affecting online users.
8. Fees and future pricing
JSimpleList is currently provided without fees. We may introduce fees, paid plans or other pricing in the future. Current free use does not create a right to continued free use.
If a pricing change materially affects an existing online account, we will take reasonable steps to give advance notice before the change takes effect. Notice may be given by email to the address associated with the account, by an in-app notification, through the JSimpleList website, or by another appropriate service communication.
We will provide relevant pricing and payment information before requiring payment.
We will not charge you automatically unless you have separately agreed to the relevant payment arrangement.
9. Service communications
If you create an online JSimpleList account, you agree that we may send communications reasonably necessary to operate and administer the service.
These may include security notices, account notices, material changes to JSimpleList, changes to these Terms or the Privacy Policy, service availability, and the introduction of or changes to fees.
Service communications may be sent by email to the address associated with your account, by in-app notification, through the JSimpleList website, or by another appropriate service channel.
Promotional or marketing communications are separate from essential service communications and will be handled in accordance with applicable law.
10. Suspension, termination and account deletion
We may suspend or restrict online access if:
- we reasonably believe an account or service feature has been misused
- use of the service creates a security, legal or operational risk
- you seriously breach these Terms of Use
- payment is required in future and remains unpaid after reasonable notice
- we need to protect JSimpleList, other users or third-party systems
Where practical, we will give notice and a reasonable opportunity to address the issue.
You may stop using JSimpleList at any time. You may delete your online account through JSimpleList where that control is available, or contact us for assistance.
Leaving, removal, account deletion or service termination may affect access to shared lists. Some information may remain temporarily in backups, security records or deletion records where reasonably necessary for technical, legal or operational purposes.
11. Privacy
Our JSimpleList Privacy Policy explains how we collect, use, store and disclose information associated with local use, online accounts and shared lists.
By using JSimpleList, you agree that information may be handled in accordance with that Privacy Policy.
12. Data protection and backups
We take reasonable steps to protect JSimpleList online systems and data. However, no online system, device or communications service can be guaranteed to be completely secure or free from failure.
You should keep any information elsewhere if losing access to it would cause significant harm or inconvenience.
13. Liability
To the extent allowed by law, JSimpleList is provided on an “as is” and “as available” basis.
We are not liable for indirect or consequential loss arising from unavailable services, device failure, internet failure, deletion, synchronisation problems, loss of access to a shared list, or reliance on list content, except to the extent liability cannot lawfully be excluded or limited.
Nothing in these Terms of Use excludes, restricts or modifies rights that cannot be excluded under Australian Consumer Law or other applicable law.
14. Changes to these Terms
We may update these Terms of Use from time to time.
If we make material changes affecting online account holders, we will take reasonable steps to notify affected users, such as by email, in-app notice or a notice on the JSimpleList website.
Where appropriate, we may require acceptance of updated terms before continued use of online features.
15. Governing law
These Terms of Use are governed by the laws of South Australia, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of South Australia and the courts that hear appeals from them.
